In early 2025, amid mounting political tensions and ongoing challenges to constitutional norms, a federal judge in Seattle issued a warning that has since resonated deeply.
Judge John C. Coughenour, appointed by President Reagan, strongly criticized the administration’s attempt to restrict birthright citizenship via executive order. His words were direct and chilling:
“It has become ever more apparent that, to our president, the rule of law is but an impediment to his policy goals, the rule of law is, according to him, something to navigate around or simply ignore, whether that be for political or personal gain.”
Birthright Citizenship Under Attack
The case, Washington v. Trump, challenged an executive order signed in January 2025 that sought to deny automatic citizenship to children born in the United States to undocumented immigrants. This executive order directly contradicts the 14th Amendment’s Citizenship Clause, which has guaranteed citizenship rights since 1868.
On February 6, 2025, Judge Coughenour issued a nationwide injunction blocking the order, declaring the policy “blatantly unconstitutional.” He noted that the administration treated the rule of law as an obstacle to be circumvented.
This injunction was upheld by the 9th U.S. Circuit Court of Appeals on July 23, 2025, affirming Judge Coughenour’s ruling and maintaining the nationwide block on the executive order.
Current Status of the Case
The appeals court’s recent ruling confirms the constitutional protections of birthright citizenship for children born to undocumented or temporary immigrant parents remain intact—for now. The Trump administration has announced plans to appeal the decision to the U.S. Supreme Court, which may ultimately settle the matter.
Until then, the nationwide injunction stands, safeguarding citizenship rights guaranteed by the 14th Amendment and preventing the executive order’s enforcement.
Why Coughenour’s Warning Was So Accurate
The judge’s statement about the president treating the rule of law as an “impediment” has proven prescient. Following the 2024 election, multiple lawsuits contested the results; many were dismissed due to lack of evidence.[1] Political unrest has heightened, testing democratic institutions.[2]
Moreover, ongoing investigations into the mishandling of classified documents resulted in indictments in 2025.[3] Civil court rulings against administration figures have further underscored a pattern of evading legal accountability.[4]
These events confirm Judge Coughenour’s early assessment: the rule of law is repeatedly treated not as a boundary, but as a hurdle to be circumvented.
A Warning Beyond America
This is not only an American issue. Around the world, executive overreach and judicial undermining threaten democratic resilience. Judge Coughenour’s ruling is a solemn reminder that courts must fiercely protect constitutional order against political expediency.
